1. ACCEPTANCE AND MODIFICATIONS OF THESE TERMS
Atollon provides its service subject to the following Terms and Conditions ("Terms"). We are deserving the right to update Terms from time to time without personal notification to our customers or partners. In the event of any modification in the Terms decided, Atollon guarantees that this change will be presented on this website and will be valid thirty (30) days after the day published herein.
2. COPYRIGHTS AND TRADEMARKS
Atollon trademarks and service marks, and other Atollon logos, product and service names are trademarks of Atollon s.r.o. Without Atollon prior permission, you agree not to display or use in any manner.
3. DESCRIPTION OF ATOLLON SERVICES
Atollon currently provides users with access to a rich collection of online software solutions based on CRM (Customer Relationship Management)
through its network of properties (the "Service").
You understand and agree that the Service is provided "AS-IS" and that Atollon assumes no responsibility for the deletion, mis-delivery or failure to store any user communications or settings.
4. OBLIGATIONS REGARDING REGISTRATION
In consideration of your use of the Service, you agree to:
a)provide true, accurate, current and complete information about yourself as prompted by the Service's registration form.
b)maintain and promptly update the registration data to keep it true, accurate, current and complete.
5. MEMBER ACCOUNT POLICY
You may receive or create a password and account designation upon completing the Service's registration process. You are agree that you are responsible for maintaining the confidentiality of the password and account. In case of any unauthorized use of your password or account or any other breach of security, you have to immediately notify Atollon. Atollon cannot and will not be liable for any loss or damage arising from your failure, which could fulfill the statement in this paragraph.
You admit that Atollon may preserve content and may disclose content if required to do so by the law or in the good faith belief that such preservation or disclosure is reasonably necessary by "objective" reasons (or issues).
6. INDEMNITY
You agree to indemnify and hold Atollon, and its partners, subsidiaries, affiliates, sales agents and employees, harmless for any consequences (all losses, expenses, damages and costs) arising from any claim or demand, transmit or make available through the Service, your connection to the Service or your use of the Service. The indemnity is also valid in case of violation of the Terms, or your violation of any rights of another.
7. NO RESALE OF SERVICE
You agree not to reproduce, copy, duplicate,ÿ resell any portion of the Service, use of the Service, or access to the Service unless you are official partner of Atollon (go to partner site).
8. GENERAL PRACTICES REGARDING USE, STORAGE, AVAILABILITY, SECURITY, SERVICE DESK
You admit that Atollon will establish general practices, limits and processes concerning use of the Service. These practices will be specified in SLA (Service Level Agreement), which will make the integral part of the Service.
9. THIRD PARTY LINKS
As a convenience to you, Atollon may provide, or third parties affiliated with Atollon may provide, links to other websites or resources. The linked sites are not under the control of Atollon, so you admit and agree that Atollon is not responsible for the availability and any content of such external sites or resources.
10. ATOLLON PROPRIETARY RIGHTS
You admit and agree that the Service and any necessary software used in connection with the Service ("Software") contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Except as authorized by Atollon or its official partners (go to partner site), you agree not to modify, sell, lease, loan, rent, distribute or create inferred works based on the Service or the Software.
11. LIMITATION OF LIABILITY
You expressly understand and agree that Atollon shall not be liable for any direct, indirect, incidental, special, punitive, exemplary or consequential damages, including damages for loss of profits, use, goodwill, or other intagible losses, resulting from:
a) inability to acces the Service, whether or not the circumstances giving rise to such cause may have been within the control of Atollon. The explicit practices will be specified in SLA (Service Level Agreement), which will make the integral part of the Service;
b) unauthorized acces or alteration of your data;
c) statements of any third party (which is not affiliated with Atollon or its partners) on the Service.
12. PROTECTION OF PERSONAL FINANCIAL INFORMATION
Use of Atollon website (primarily Atollon e-shop) involves electronic transmission of personal financial information. By accessing your account online, your consent becomes effective and remains in effect at all times while the site is in use by you. In addition, Atollon recommends that you employ all reasonable and practicable means to protect the privacy of your personal information. 13. APPLICABLE LAWS
Your use of this site shall be governed in all respects by the laws of the Czech Republic. Our site can be reached from many countries around the world.
